Terms & Conditions 2019

When you book your travel arrangements with us you are entering into a contract with Davington Events Ltd also trading as Davington Tours & Events and London Guided Tours.
Our office address is: 70 Ravenscroft Road, Beckenham, Kent, BR3 4TR.

This is the full version of our terms and conditions which we ask you to read carefully before confirming your arrangements. When you make a booking as the group leader or first named person on the booking you accept the terms and conditions on behalf of everyone in your party.

Davington Tours & Events aims to be fair, reasonable and sympathetic in all our dealings with clients, and to act always with integrity.

Accuracy

Davington Tours & Events aims to provide full and accurate information about our tours. Any changes that may affect your itinerary will be communicated to you promptly.

Payment terms

A deposit payable by return will be required at the time of confirmation to secure the booking. This will include any payments required by us to secure your reservation with our suppliers. If we do not receive your deposit on time we cannot guarantee that we are able to fulfill the travel arrangements as described.

Full payment must be made according to the instructions we give. If we do not receive payment due in full and on time, we reserve the right to cancel your booking and in this case cancellation charges will apply.

Cancellations

You may need to cancel your arrangements prior to their commencement in the event that there are extraordinary and unavoidable circumstances occurring at your destination and i) those circumstances make it impossible to travel safely to your destination ii) the performance of your arrangements will be significantly affected by those unavoidable and extraordinary circumstances. We will refer to Foreign and Commonwealth Office guidance when determining whether your booking is affected. In this event, you will receive a refund without undue delay of any payments made but this is the maximum extent of our liability and we regret that we cannot meet any other expenses or losses you may incur as a result.

If any member of your party is unable to travel you may transfer that place to someone else provided we are notified in writing not less than seven days prior to travelling. You will be liable for any costs or fees associated with transferring the place. If you are unable to find a replacement, cancellation charges will apply and additionally, there may be an extra charge if the accommodation is then underoccupied.

Changes

Sometimes circumstances arise which prevent us from operating a tour exactly as advertised. If this is the case, we would do our very best to offer a satisfactory alternative that is as near as possible to the original arrangements. In the case of a major change which is not acceptable to you, we would provide a full refund if you decide to cancel your booking. Examples of a major change are:

– a significant change of destination (city or resort) that would negatively affect the fulfillment of the itinerary
– change to a hotel of inferior star rating or quality
– change of departure date

Changes of a minor nature will not be subject to a full refund on cancellation. Examples of minor changes are:

-change of hotel to one of a similar or superior star rating
-change of destination that would not adversely affect the itinerary
-running order of itinerary

Insurance

As a condition of our agreement you must be covered by adequate travel insurance. Minimum cover must include cancellation, medical issues and repatriation in the case of illness or accident. If you choose to travel without travel insurance we will not be liable for any expenses howsoever arising in of which insurance cover would otherwise have been available. You should advise your insurer of any pre-existing conditions. Your travel cover should include cover for any activity that you have as part of your itinerary, i.e. winter sports. If you are a British citizen you should take your European Health Insurance Card (EHIC) with you when travelling in Europe.

Special requests

Any special request or dietary requirement should be communicated to us in writing at the time of booking. We will pass these requests on to the relevant suppliers and whilst we endeavour to meet all special requests we cannot guarantee that they will always be available. If you require the request to be guaranteed and therefore part of the agreement, we will contact our suppliers and if they agree it can be provided we will confirm it to you in writing. The failure to provide any special request or dietary requirement that has not been confirmed by us in writing will not form a breach of contract on our part.

If a member of your party has any medical condition or disability which may affect the trip please advise us at the time of booking.

The price you pay

We reserve the right to increase the price of any package before confirmation is received.

Once you have confirmed your booking and paid the deposit we guarantee to provide the arrangements at the agreed price with the exception of the following circumstances:

  1. An increase in the level of taxes or fees imposed on your arrangements by third parties such as (but not limited to) tourist taxes, landing taxes and embarkation or disembarkation fees at ports and airports.
  2. The price of the carriage of passengers resulting from the cost of fuel or other power sources
  3. Exchange rate changes relevant to the package

Our Responsibility

We accept responsibility as an “organiser” under the Package Travel and Linked Travel Arrangements Regulations 2018. We want all of our customers to be happy and we strive to provide excellent service throughout. However, subject to these booking conditions, should we fail to arrange or perform your travel arrangements in accordance with our agreement, we will undertake to remedy any complaint you may have. If that is impossible or entails disproportionate costs (taking into account the extent of the lack of conformity and the value of the arrangements affected), we will pay compensation according to the regulations. In the unlikely event that you should have cause for complaint you should inform your Tour Director immediately or contact us on (+44) 203 664 8691 to ensure that we have the chance to rectify any problems as soon as possible. Failure to do so could jeopardise your right to any compensation.

Added extras

Any extra services arranged for you such as excursions, sporting activities etc that are run by a third party are provided by the Service Provider who will operate under their own terms and conditions and we are acting as agent. As an agent, we accept no responsibility for acts or omissions of the Service Provider. Our responsibilities are limited to making the booking according to your instructions and taking payment on behalf of the Service Provider.

13. Jurisdiction and applicable law

This contract and all matters arising out of it are governed by the law of England and Wales.

Financial Security

We provide financial protection against insolvency of London Guided Tours / Davington Events Ltd via the Travel Regulations Insovency Protection plan adminstered by Towergate Chapman Stevens.

The policy does not cover any moneys paid for any claims regarding flights. Please ensure that they company you book your flights with has the appropriate CAA / ATOL bonds in place.

Passports and documents

It is your responsibility to ensure you fulfill the passport, visa and health requirements applicable to your itinerary. We can only give you broad guidelines on this. You must check the requirements for each relevant destination. Most countries now require passports to be valid for 6 months after your return date but you should check with the Embassy of the relevant country. We cannot accept liability if you are refused entry to any country due to the failure on your part to ensure you have the correct documents including necessary visas and health requirements.

Data and Privacy Protection

We need to ask you for some data in order for us complete your booking. We make sure that only the data necessary for completing your booking is passed on to our suppliers, such as hotels and transport companies, and we take full responsibility for protecting your data. Any information such as passport details will be destroyed after you travel and will not be kept on file.

If your itinerary is outside the EEA, local data protection laws may not be as strong as they are in the UK. We will need to pass on your data in order to make your booking. By accepting these terms and conditions you consent to us passing on your information to the necessary persons.

We do not share any information with third parties for the purposes of marketing.

General Information

Leisure facilities

Hotels that offer leisure facilities such as swimming pools, hot tubs, saunas and steam rooms will determine their own rules for their use. Often facilities such saunas cannot be used by children under the age of 14 or 16. Opening hours of facilities are determined by the hotels and sometimes there are charges that apply. There are not usually lifeguards on duty.

Special diets and allergies

We do our very best to provide special diets such as vegetarian, gluten free and non-dairy. However, in many countries vegetarianism and veganism is not as common as it is here and therefore the variety of food on offer can be restricted.

If any member of your party has an extreme food allergy please let us know at the time of booking. If the allergy has the potential to be life threatening we reserve the right to advise you that should they choose to travel it is at their own risk.
